Workman’s Compensation

Many subcontractors have workman’s comp policies even if they aren’t required.  It’s smart business.  Hire them.  At the very least, hire only subs with workman’s comp for jobs that have workers on ladders or scaffolding ─ framers, brickers, roofers, painters, etc.

These are the most hazardous jobs for laborers.  If such a laborer is injured on your job site and his subcontractor employer has no workman’s comp, you could be exposed.

 

My advice is to hire only subs with workman’s compensation insurance.


But your choice may not be that clear cut.   Many subs may not have workman’s comp because it may not be required.  Or those that do have it may not be ready to work when you want them, among other things.


It’s a judgement call, with the question being, how much risk is involved for a particular job, and do you have your own policy which will cover you in the event of accident.

 

Shoud You Incorporate (Limited Liability) For Building Purposes?

 

While we’re talking about insurance to protect yourself, there’s another step you might be able to take to add another layer of protection against liability.

Your building inspector’s office may allow you to obtain a building permit as a corporate entity.

In the event of accident at your job site, if the lot is owned by, and the house is being built by a corporation, this would tend to protect your personal assets if a claim were made against you.

This is not legal advice.  This is merely to inform you of an option you may have.  Consult with an attorney.  You will incur some expense in the incorporation process, but it will be minimal.


Incorporating just means you're being extra cautious in our litigation society.

When we’ve got Americans suing somebody because their coffee is too hot, more protection is probably a good thing.

I hope none of this alarms you.  Serious injuries at house building sites are actually rare.  I’ve never had one in twenty years.  But you have to take all reasonable precautions, nonetheless.
